1. Acceptance of Terms

By downloading, installing, or using the Two Hearts application ("the App") or visiting the website twoheartsapp.com ("the Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Service Description

Two Hearts is a free mobile application for iOS and watchOS that enables users to:

• Share their heart rate with chosen friends and family members
• View connected friends' most recent heart rate data
• Send heartbeat notifications to connected friends
• Feel friends' heartbeats through haptic feedback on iPhone and Apple Watch

The Service is operated by VoiceBeam GmbH.

3. Eligibility

You must be at least 13 years old to use Two Hearts. By using the Service, you represent that you meet this age requirement. If you are under 18, you should have your parent or guardian's permission to use the Service.

4. Account Registration

To use Two Hearts, you must create an account using Sign in with Apple. You are responsible for:

• Maintaining the security of your Apple ID
• The accuracy of your profile information (username, display name, profile picture)
• All activity that occurs under your account

5. Acceptable Use

You agree to use Two Hearts only for its intended purpose and not to:

• Attempt to access other users' data without their consent
• Use the Service for any unlawful, harassing, or abusive purpose
• Impersonate another person or create fake accounts
• Attempt to reverse-engineer, modify, or interfere with the Service
• Upload inappropriate or offensive content as your profile picture
• Use automated tools or bots to interact with the Service

6. Health Data Disclaimer

Two Hearts is NOT a medical device. Please read this section carefully:

• Heart rate data displayed in Two Hearts is for informational and social purposes only.
• Do not rely on Two Hearts for medical decisions, diagnosis, or treatment.
• Heart rate readings originate from Apple HealthKit and your Apple Watch. These readings may not always be accurate and can be affected by motion, fit, and other factors.
• If you have concerns about your heart rate or health, always consult a qualified healthcare professional.
• Two Hearts is not intended to detect, diagnose, or treat any medical condition.
• VoiceBeam GmbH is not responsible for any health-related decisions made based on data displayed in the App.

7. User Content

You retain ownership of any content you provide to the Service, including your profile picture and display name. By using Two Hearts, you grant us a limited, non-exclusive license to display this content to your connected friends within the App. This license terminates when you delete your account.

8. Privacy and Data

Your privacy is important to us. Please review our Privacy Policy, which explains what data we collect and how we handle it. Key points:

• We only store your username, display name, profile picture, and heart rate data
• Heart rate data is automatically deleted after 24 hours
• We do not share your data with third parties
• You can delete your account and all associated data at any time

9. Pricing

Two Hearts is currently provided free of charge. There are no subscriptions, in-app purchases, or advertisements. We reserve the right to introduce optional paid features in the future, with advance notice to users. Any existing free features will remain free.

10. Service Availability

We strive to keep Two Hearts available at all times, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to:

• Scheduled or emergency maintenance
• Server issues or third-party service outages
• Factors beyond our control

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice.

11. Intellectual Property

The Two Hearts app, website, logo, and all related content are the property of VoiceBeam GmbH. You may not copy, modify, distribute, or create derivative works based on our intellectual property without our written permission.

12. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

• The Service will meet your specific requirements
• The Service will be uninterrupted, timely, or error-free
• Heart rate data will be accurate or complete
• Any defects in the Service will be corrected

13. Limitation of Liability

To the maximum extent permitted by applicable law, VoiceBeam GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service. This includes, but is not limited to, damages for loss of data, health-related outcomes, emotional distress, or loss of profits. Our total liability for any claim arising from the Service is limited to the amount you paid for the Service (which is zero for the free tier).

14. Account Termination

You may stop using Two Hearts and delete your account at any time from within the App. Upon deletion, all your data is permanently removed from our servers. We may suspend or terminate your account if you violate these Terms, with or without prior notice.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Germany.

16. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms. If we make significant changes, we will make reasonable efforts to notify users within the App.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
